Three Alice residents filed police reports Wednesday against three Alice councilwomen for abuse of office.
The reports listed as abuse of official capacity against Yolanda Sosa Moran, Elida Garza and Cynthia Carrasco, who won the May 6 election.
The residents who filed were Fernando Casas, Merlinda Rodriguez and Cynthia Luera.
Moran and Garza were recalled by citizens in June. The women were sworn into the Alice City Council on May 11.
Texas Penal Code Sec. 39.02. ABUSE OF OFFICIAL CAPACITY. (a) A public servant commits an offense if, with intent to obtain a benefit or with intent to harm or defraud another, he intentionally or knowingly:
(1) violates a law relating to the public servant's office or employment
A document was presented to the officer requesting to file criminal charges against the councilwomen, according to police reports.
“The women have violated the Texas Penal Code 39.02 for official misconduct for tabling the agenda item about setting a recall election in violation of City of Alice charter 36A's express mandate with intent to obtain a benefit, intent to harm or intent to defraud violating a law relating to their public office,” according to the police reports.
The councilwomen have not be charged with any wrongdoing.
