Judge Bobby Galvan of the 94th District Court recently granted a plea to the jurisdiction effectively dismissing a lawsuit filed against the City of Corpus Christi which alleged the negligent use of a motor vehicle.

On September 28, 2008, a car collided with a parked brush truck in the 3900 block of Lamont owned by the City of Corpus Christi. The collision resulted in the death of Christopher Raymond Regino and Ivan Madrid. A passenger in the car was also seriously injured.

The lawsuit dismissal was based on the fact the vehicle in question was not being used by the City at the time of the accident. “This is a horrible, tragic accident and we feel for the families of those involved, but the City was not in any way responsible for causing it,” said First Assistant City Attorney Alison Logan. “We will continue to vigorously defend the City against these types of cases,” added Logan.
